VOTE: 2-0 MOTION CARRIED
TOPICS NOT REASONABLY ANTICIPATED BY THE CHAIR 48 HOURS BEFORE THE MEETING:
Ms. Sullivan posed a situation: owners of an existing house that is 10ft. from the leaching field wants to
add an addition in line with the house such that the addition will also be 10ft. from the leaching field.
Code requires 20 ft. setback from the leaching field. Proposed addition would be on a crawl space, not a
full foundation and basement. Engineer noted that sometimes Towns will show discretion to existing
projects and waive the 20 ft. requirement and allow the addition to continue the 10ft. setback. Ms.
Sullivan asked the BOH members how they would opine. Dr. Dickstein and Dr. Lawrence both agreed
that this proposed addition is not an existing project, it is a new project and that the owner could build
the addition to be 20 ft. from the leaching field. Both agreed to disallow the addition to continue the 10
ft. setback and that the plans must comply with the statute.
