PLACE: COHASSET TOWN HALL—Board of Health Office 41 HIGHLAND AVENUE, COHASSET, MA 02025 Board Members Present: Interim Director of Public Health: Robin Lawrence, Chairman Jennifer Sullivan Harvey Dickstein, Vice Chair Public Health Nurse: Board Member Absent: Mary Goodwin (ABSENT) Lynn Doxey, Clerk Recording Secretary: Amy Davis 7:05 P.M. Dr. Lawrence opened meeting 7:05P.M. Amy Davis, new Administrative Assistant for Board of Health was introduced to the Board 7:07 P.M. APPROVE MEETING MINUTES FROM JULY 11,2017 MEETING MOTION BY: Dr. Lawrence to approve the July 11, 2017 Meeting minutes SECONDED BY: Dr. Dickstein VOTE: 2-0 MOTION CARRIED 7:08 P.M. APPROVED THE WARRANT MOTION BY: Dr. Lawrence to approve the 07/18/17 to 08/09/17 warrant SECOND BY: Dr. Dickstein VOTE: 2-0 MOTION CARRIED The members signed the warrant 7:10 P.M. PUBLIC HEALTH NURSE REPORT Materials used for this agenda item: • Public Health Nurse July, 2017 Report (See attached) Public Health Nurse absent— Board reviewed prior to meeting and accepted report at meeting. Jennifer Sullivan added that extra enterococci testing has been required at Sandy Beach, and Sandy Beach had to be closed for one day because they had two high tests in a row. 7:12 P.M. CHAIRPERSON'S REPORT—Dr. Lawrence did not give a Chairperson report at this meeting 7:15 P.M. DIRECTOR OF PUBLIC HEALTH REPORT Materials used for this agenda item: Public Health July-August, 2017 report(See attached) Jennifer Sullivan reviewed all items in her report. • 25 Ripley Road: Board members would like the Building Commissioner and Mr. Charles to attend the next BOH meeting on September 19, 2017 at 7:00 to discuss the ongoing issues with this property. • 312 Jerusalem Road: Board members would like to have the home owner and someone from the Cohasset Fire Department to attend the next meeting on September 19, 2017 to address the issues as stated in Ms. Sullivan's report. August 15,2017 BOH Meeting APPROVED • Manor Way Circle Septic Plans: Sent plans back to engineer- need new set of plans before BOH can move forward • Cohasset Maritime Institute: The "rib-off"that was planned has been canceled due to not being able to comply with town regulations. The event is now private and not open to public • Salt House: is now open • 471/473 Beechwood Street: Failed septic system and unsafe front steps. Arrangements for repairs have been made. • Star Bucks Plaza: Septic system is not working properly. Ms. Sullivan has tried to contact the management company to no avail. Dr. Lawrence stated management needs to comply. Ms. Sullivan will continue to try and contact them. 7:25 PM HOLLY HILL FARM FOOD TRUCK APPROVAL In attendance to represent this agenda item: Chef Katie Callahan,Jeanne White Materials used for this agenda item: None Health Agent Jennifer Sullivan reviewed all items and explained that the kitchen in the house behind the stationary site of the food truck, where 95%of the food will be prepared, has been approved. Gloves will be worn and chemical sanitation for hands will be used. Also Holly Hill will need to have test strips to test the sanitizing system and record the results in a log. Both MS. Sullivan and the State are in agreement on the menu. Holly Hill needs to replace woks on truck with grills to be able to serve grilled cheese and sausage sandwiches which have been FDA approved. Ms. Sullivan said there will have to be one final inspection before operations begin. MOTION BY: Dr. Dickstein to approve the plans(in a stationary mode) as described SECONDED BY: Dr. Lawrence VOTE: 2-0 MOTIONED CARRIED 7:32 PM - 153 SOHIER STREET SEPTIC SYSTEM In attendance to represent this agenda item: James Colantonio, Engineer; Matthew & Cassie Malatesta owners of 153 Sohier St., and Lance a neighbor at 163 Sohier St. Materials used for this agenda item: • Application for Disposal System Construction Permit, date stamped : 07/28/17 • Form 11-Soil Suitability Assessment for On-Site Sewage Disposal, dated 07/27/17, date stamped: 08/15/17 • Wastewater System Calculations, prepared by James J. Colantonio, dated: 08/10/17, date stamped: 07/28/17 • Proposed Septic System Plan Sheet 1 of 1, prepared by JJ-Col Consulting, dated 07/27/17, date stamped: 08/15/17 Mr. Colantonio reviewed plans with the board members and Ms. Sullivan. In addition to the approval of the plan, a variance is required for the 7 ft. setback(10ft. required) from the property line.Also another variance is required for the 3%(21 sq.ft. of the system)which lies within the 400 ft. buffer zone. Abutter at 163 Sohier St. did not have any issues with the plans. MOTION: Dr. Dickstein moved to approve the proposed septic system design at 153 Sohier St., Engineer:JJ-COL Consulting, issued July 27,2017 SECONDED: Dr. Lawrence VOTE: 2-0 MOTIONED CARRIED August 15,2017 BOH Meeting APPROVED MOTION: By Dr. Dickstein to approve a variance for the setback from the property line, required 10.0 ft. and provided as 7.Oft. SECONDED: By Dr. Lawrence VOTE: 2-0 MOTION: Dr. Dickstein to approve a variance for the 21 sq.ft. of leaching area which infringes into the 400 ft. separation boundary from James Brook SECONDED: Dr. Lawrence VOTE: 2-0 MOTION: Dr. Dickstein to approve the septic system plan issued 07/27/17 for 153 Sohier St. SECONDED: Dr. Lawrence VOTE: 2-0 MOTION CARRIED TOPICS NOT REASONABLY ANTICIPATED BY THE CHAIR 48 HOURS BEFORE THE MEETING: Ms. Sullivan posed a situation: owners of an existing house that is 10ft. from the leaching field wants to add an addition in line with the house such that the addition will also be 10ft. from the leaching field. Code requires 20 ft. setback from the leaching field. Proposed addition would be on a crawl space, not a full foundation and basement. Engineer noted that sometimes Towns will show discretion to existing projects and waive the 20 ft. requirement and allow the addition to continue the 10ft. setback. Ms. Sullivan asked the BOH members how they would opine. Dr. Dickstein and Dr. Lawrence both agreed that this proposed addition is not an existing project, it is a new project and that the owner could build the addition to be 20 ft. from the leaching field. Both agreed to disallow the addition to continue the 10 ft. setback and that the plans must comply with the statute.
