PLACE: COHASSET TOWN HALL—BASEMENT MEETING ROOM 41 HIGHLAND AVENUE, COHASSET, MA 02025 Board Members Present: Robin Lawrence, Chairman Harvey, Dickstein, Vice Chair Lynn Doxey, Clerk Director of Public Health: Susan Sarni Public Health Nurse: Mary Goodwin Recording Secretary: Chrissie Dahlstrom 7:01 PM—Chairman Lawrence called the meeting to order. 7:03 P.M. - Dumpster Permit for Perch 143 In attendance for this meeting: J. Keith Phifer, Owner and Manager of Perch 143 at 8 Stagecoach Way which owns the ally in question; Attorney Jonathan Norris representing the Harrison Family at 7 South Main Street which as a right of way through the street in question The alley adjacent to the proposed Perch 143 is owned by Keith Phifer. Mr. Harrison has a right of way on this property. Currently the alley is used for trash pickup and some deliveries. There is no other traffic in the alley. The neighboring establishments have discussed having a communal dumpster. Mr. Phifer has attempted to reach Mr. Harrison via email and phone to discuss the possibility of communal dumpsters and has not been able to reach him. The Board was asked if the dumpsters have caused any problems and Attorney Norris stated there were not any safety issues. The Harrisons have been annoyed with the trash that doesn't make it into the dumpsters. Currently, Mr. Phifer places two dumpsters end to end in the alley along the building wall. The Harrisons never wanted the dumpsters in the right of way. The Norfolk County Deed states the right of way is for loading and unloading vehicles. It does not state whether or not a dumpster can also occupy the space. The Dumpster Regulations state..."each dumpster must be located at a distance from the lot line as not to interfere with the safety, convenience or health of abutters or residents. Dumpster location must be approved by the Board of Health." The alley is 14' wide. The dumpsters are on wheels and are 2' x 2' x 4' with a locking mechanism. With the dumpsters in the alley, there is a 10' access through the alley. There is not a required width for right of ways. Mr. Norris measured a wide garbage truck and the width was less than 10' and could enter and exit the alley without trouble. MOTION: By Mr. Dickstein to Approve the Configuration of the Dumpsters as Presented Two Dumpsters End to End Along the Building Wall Board of Health Meeting FINAL 2 of 5 November 29,2016 SECOND: Lynn Doxey VOTE: 3—0 MOTION CARRIES Ms. Sarni told Mr. Phifer his project manager could submit a dumpster application prior to opening the new food establishment. 7:32 P.M. - Fiori Gulf Septic Review—734 Chief Justice Cushing Highway In attendance for this meeting: Jack O'Leary, Site Tech The septic system at Fiori's Gulf at 734 CJC Hwy. was installed in 1970. In 1998 the gas station had a renovation adding a drive thru and new tanks. The Title 5 system was failing and the new owners hired Sitec to replace the leaching field. The failing system is under the pavement to the right of the building along CJC Hwy. Sitec is proposing the place a new leaching field behind the building to the left along Beechwood Street. The plan is to pump into the existing tank and chamber with a possible valve that creates flow to the new leaching field. Mr. O'Leary explained a leaching field can rejuvenate itself when not in use, which is why the Board should consider the valve. Dunkin' Donuts is located inside this building with a drive-thru. In 1998 a grease trap was not installed with the renovation. Sitec would like to install a 2000 gallon grease trap. Discussion ensued on whether or not an abandoned system would create settling in the earth, which would disrupt the drive thru traffic. Ms. Sarni will talk to the Department of Environmental Protection about this issue of installing the valve to the existing soil absorption system. Perhaps a condition could be added to the deed at 734 CJC Hwy. adding a valve that can be turned on and off to the existing system. This was a discussion; no vote was taken at this time. 7:50 P.M. - 365 North Main Street In attendance for this meeting: Noel Collins It was noted this item was not on the agenda and no vote will be taken after the discussion. Mr. Collins is selling the property and has a closing date of December 14, 2016. There are 2 garages and 1 main building. A local artist is interested in purchasing the property and would like to use the main building has her home, 1 garage as her studio and the other garage to park her car. The cesspool would need to be upgraded to a Title 5 system. The most current plans were drawn by Neil Murphy in 2005. Mr. Collins believes there are current plans, but neither he nor the BOH have a record of those plans. There was an approval in 2001, which expires in 2 years if there isn't a request for an extension. Mr. Collins states he received a verbal extension from Mr. Godzik, however, there is no record of this. He also states Mr. Bobo issued him a variance and there is no documentation of that. Board of Health Meeting FINAL 3 of 5 November 29,2016 The Assessor's Office has the dwellings/garages listed as 2200 sf. The total flow for that size building would be a 1 bedroom septic design. Clarification is needed upon what the tax bill is based on. The Board recommended Mr. Collins to bring to the next hearing: • new septic plan • two test pits in each leaching area • Perc test results 8:07 P.M. - 790 Chief Justice Cushing Highway Two orders have been written by the BOH for the property manager to address the sagging pipe running into Shoe Market. If there is no response it will be on the agenda for discussion on January 10, 2017. 8:10 P.M. - Authorization of Code RED The Fire Department and Glen Pratt require the Board to approve Susan Sarni to become the point of contact for the Code RED. MOTION: By Mr. Dickstein Approve the Fire Department and Glen Pratt's Recommendation to Assign Susan Sarni as the Point of Contact for Code RED SECOND: Robin Lawrence VOTE: 3—0 MOTION CARRIES 8:12 P.M. - Discussion Regarding the Solar Panels @ the Landfill 81-91 Cedar Street The solar panels cannot move forward with their project at the landfill without plans the BOH needs to approve. To date the DEP has not submitted the Closure Permit or the Post Closure Permit. 8:15 P.M. - Update on GIS Mapping of Septic System Intern Ms. Dahlstrom is assisting with the mapping of the septic systems within the GIS system, has finished going through the septic files for individual residences in Cohasset. The next step is to color code each system by type. The map shows that ages of the septic systems and most were installed between 1990-2010. 8:20 P.M. - Approve Meeting Minutes from Tuesday, October 18, 2016 MOTION: By Mr. Lawrence to Approve The Meeting Minutes of October 18, 2016 SECOND: Mr. Dickstein VOTE: 3—0 MOTION CARRIES 8:22 P.M. - Warrant The Board signed the Warrant, and appointed Robin Lawrence to sign on behalf of the Board should a situation arise that an invoice needs to be approved prior to the next meeting. Ms. Goodwin can send these back after June and receive a reimbursement for the unused doses. On October 25, 2016, Ms. Goodwin attended the first meeting at the Paul Pratt Library as an advisory board member of the Equal Access for All initiative, which aims to improve access to library services by connecting people challenged by disabilities with adaptive technologies.This initiative is federally funded. 8:27 P.M.- Director of Public Health Report Ms. Sarni continues to discuss the failed septic systems on CJC Hwy. with the Sewer Commission. Ross Rosano will be installing the system at 382 Beechwood Street on December 5, 2016. It was discovered there are 40 meeting minutes that were not recorded. The dates range from 2006 to 2012. Chrissie Dahlstrom and Angela Geso will be working extra hours to complete the minutes. Some of the agendas are also missing. Board of Health Meeting NQL 5 of 5 November 29,2016 The following items were approved by the DPH with the Emergency Preparation Grant money: • Wind n Go UltraLight Flashlight 2/AM FM Radio and cell phone charger • Cell phone charger for shelter • Emergency Prep Cards on how mobile notification for emergency notification and how to shelter in place • Foot Buckets and Towels for shelter • Pac n Play for shelter • Portable Hook on chairs (for babies) for shelter The new Animal Control Officer, Brian Willard, created a spreadsheet of 16 addresses with a variety of farm animals. Zoning regulations require no person shall stable or otherwise keep and/or maintain any animal above a certain quantity. Therefore, according to his log there would be 7 new animal applications. The application should be reviewed by the Board at a regular scheduled meeting. All abutters must also be notified. 8:45 P.M.
