Next meeting was set for Monday, November 3, 2015. AG was instructed by MC to send a letter to the abutters of 97 Forest Avenue/Dietrich as voted on at the emergency meeting of October 2, 2015 to waive the 10-day notice variance. FZ brought up the issue of temporary(or cosmetic)tattoos being exempt from the variance as written. PC requested this be placed on our next agenda and pointed out we didn't exempt `temporary'when drafting the original variance but we could use the term "cosmetic"to include semi-permanent. 7:30 PM ANIMAL REGULATION ENFORCEMENT UPDATE - 14 NICHOLS ROAD/SLANETZ (AS) IN ATTENDANCE: JAMES MAHAR (JIM) . PAULA BELCHER(PB), IRENE (IB) AND MICHAEL (MB) BARRY/ABUTTERS Since Sept. 24 Mr. Slanetz has been fined $50 a day for disregarding the request to get rid of the rooster at his property. FZ said that if suggested updates to the current Animal Regulations are approved, AS could file for a permit and go through the proper channels of notifying abutters. PC asked why would we consider the new regulations since the original issue was when the old regulations were in order and this should come under that. FZ tried to find a home for the rooster but had no takers. MSPCA could take the rooster but our regulations do not allow for seizure. AS felt it was disingenuous to make plans without involving him but PC said AS was given a direct order to deal with the rooster and he did not. AS says he was unaware of any problems with his neighbors but by soundproofing the coop he has solved their problem. PB said the abutters have let AS know about the issue but he has been unresponsive. FZ explained that a 21 D Citation is non-criminal and required a fine be paid or appeal be filed; after 21 days with no action taken the town will file a criminal complaint. PB says the neighbors will expect an ENF after 21 days. PC pointed out that if AS does indeed file a permit he will have to get approval from all neighbors/abutters. PB, JM and IB both said they made numerous attempts to reach the Animal Control Officer and Health Agent to no avail. PC felt that this should be addressed as a nuisance complaint and not strictly an animal complaint and should be addressed and also reiterated that this issue would be evaluated under the old regulations and not any updated reg's because there is no grandfathering in and the incidents occurred under the old reg's. AS wants a course of action but FZ said he already has one. 7:45 PM DISCUSSION/DEVELOPMENT OF POLICY VARIANCES RE: TITLE 5 moved up due to 7:30 hearing running over 8:00 PM DSCP HEARING: NEW CONSTRUCTION, 321 BEECHWOOD STREET— LOTS 1 AND 2: REPRESENTED BY GREG TANSEY (GT)/ENGINEER AND DUSTIN WHEELWRIGHT (DW)/OWNER This hearing regards 2 separate non-contiguous lots at the same site. Lot 1 perc'd satisfactorily. It has a pressure-distribution system with a network instead of a D-box leading to a leaching field. GT describes it as a better system that promotes a healthy bio-map with a liner inside a retaining wall. It is a 4 BR design. Board of Health Meeting October 14,2014 2 MOTION: Member Kirkpatrick moved to approve the septic design plan as shown in revised plans dated 10/14/14for new construction on Lot 1, 321 Beechwood Street. SECOND: Member Lawrence APPROVED: Unanimous Lot 2 is based on a similar premise as Lot 1 but will be a 2 bedroom and will have a reserve field that is same as Lot 1 but smaller. The lot perc'd satisfactorily. A deed restriction is needed for a disposal and a covenant is needed for the design field. MOTION: Member Lawrence moved to approve the septic design plan as shown in revised plans dated 10/14/14 for new construction on Lot 2, 321 Beechwood Street with a deed restriction limiting construction to a 2-bedroom dwelling and for a garbage disposal. SECOND: Member Kirkpatrick APPROVED: Unanimous 8:30 PM DSCP HEARING: NEW CONSTRUCTION — LOT 3 BLACK ROCK ROAD: REPRESENTED BY JEFF HASSETT/MORSE ENGINEERING AND ERIC ZINE (EZ)/OWNER IN ATTENDANCE: Barbara (BW) and Kevin (KW) Wrenn, Patrice Vogelman (PV), Jack Kennily (JK), James McLaughlin (JMC), John Kennily(JOK) This hearing regards new construction of a single family dwelling. JH said the property shares a driveway with #29 and severe ledge and slopes to rear. The proposed system is 1500 gal. gravity-fed with a D-box and arc chambers. They could do a conventional trench but went with arc so if fails it can be ripped out and replaced. The system is 3-BR/cannot accompany a 4-br. There is a deed restriction for a garbage disposal. The retaining wall will not interfere with the neighbors. JK of 46 Black Rock said there is a history of failed septics on the road and other construction had sewer stub accessibility. The lot behind him never perc'd because of severe ledge. PC feels Lot 3 seems to have good material and not ledge. FZ stated that if the Sewer Commission says it's feasible to connect within 3 years then the BOH cannot grant a septic permit. JMC said the cost of going through ledge can be prohibitive in this situation. JK wants a second opinion and wants to perform his own perc test but PC said the pocket of material found was suitable and the perc test cannot really be thrown out. FZ said if JH cannot do the installation as planned there will be a new hearing. MOTION: Chair Chapman moved to approve the septic design as shown in plans dated 9/30/14 for Lot 3, Black Rock Road with the condition that the Sewer Commission determine feasibility of hooking up to town sewer within 15 months. SECOND: Member Kirkpatrick APPROVED: Unanimous MINUTES APPROVED: DECEMBER 15, 2015
