HomeMy WebLinkAboutMinutes - BoH - 09/08/2014 Board of Health Meeting September 8,2014 1 APPROVED MINUTES COHASSET BOARD OF HEALTH MINUTES DATE: MONDAY,SEPTEMBER 8,2014 TIME: 7:OOPM PLACE COHASSET TOWN HALL-DOWNSTAIRS MEETING ROOM 41HIGHLAND AVENUE, COHASSET, MA 02025 Board Members Present: Margaret S.Chapman, (MC) Elizabeth Kirkpatrick (EK) Robin Lawrence (RL) Staff Present: Felix Zemel(FZ) Health Administrator Angela Geso (AG),Administrative Public/Guests Present: Paul Murphy (PM), Animal Control Officer Al Slanetz(AS),Resident Erin Dale(ED),Repo rter,Cohasset Mariner Michael Barry(MB), Resident Jeff Hassett(JH),Morse Engineering Meeting called to order at 7:15pm.Next meeting is scheduled for Tuesday,October 14, 2015. REPORTS AND UPDATES FZ attended training in NYC on "Managerial Control in Food Establishments" to help ensure food safety. FZ is going to run training classes to local food establishments. There will be information presented at the next meeting regarding Permit Tracking Software. Bob Egan and Joanne Pilczak have been looking into various programs. Chris Senior will offer a report. FZ reported on recent enforcement actions. There were complaints from residents of Fairoaks Lane regarding a film crew working on a documentary at a residence. Crew members were smoking in the street and residents found this offensive. Arrangements were made for a designated smoking area to the rear of the property. FZ has received animal complaints concerning roosters on Nichols Road and Lamberts Lane. The Nichols Road complaint is on the agenda to be discussed later in the meeting. The Yerardi residence at 71 Nichols Road is connecting to sewer. Town Manager Chris Senior received a complaint of a dumpster at 90 Doane Street, a property that had been previously cited for excessive trash. The property was cleaned up and the waste put in a dumpster in the front yard. The Building Inspector had requested non-enforcement of the dumpster regulations in this instance.MC did not see the dumpster as an issue as it won't be on the property forever and its not a health problem or a site nuisance at this time. FZ asked if the BOH wants to work with Stormwater Advisory regarding the effect of organic lawn fertilizers and nutrients on groundwater.MC suggested they consult articles written by Steve Bobo which will give them all the information they need. 7=30PM DSCP HEARING &POSSIBLE LOCAL UPGRADE APPROVAL: 413 NORTH MAIN STREET- Represented by Jeff Hassett/Morse Engineering The system is on a small lot and is being replaced by a Hoot drip treatment system consisting of 3 compartments: a holding tank,a chamber that aerates and breaks down the waste and atank where the waste settles. It is a geoflow design that follows the topography.JH is looking for a variance on the Board of Health Meeting September 8,2014 2 setback from 1 Uto T due to the limited space available. MOTION: Made by Margaret Chapman for variance approval with amendment that in addition to pumping there would be a visual assessment of the field;the variance does not go into effect until an acceptable covenant is recorded with the Registry of Deeds and a deed restriction be in place that requires the property connect to sewer once sold. 2nd: Robin Lawrence VOTE: 3-0 Motion Carries 7:45 PM DSCP HEARING AND POSSIBLE LOCAL UPGRADE APPROVAL:19 STANTON ROAD- Represented by Jeff Hassett/Morse Engineering Board of Health Meeting September 8,2014 3 This is a failed system. The tank is being removed and the field abandoned as there were groundwater issues due to the depth. The new system has a 1500 gallon tank, a 1000 gal pump chamber and pressure distribution to the new leaching field. They are asking for a reduction from 4'to 3' due to the ground height. 8:00PM ANIMAL REGULATIONS:REVIEW AND DISCUSSION The Board was given a draft of Rules and Regulations Governing Horses.Stables. Cloven-Hoofed Livestock.Fowl and Poultry with current revisions to be reviewed and possibly approved. Fees governing the number of specific animals allowed at a residence were discussed;these would only apply if the number of certain animals was over the recommended threshold. It was decided to consider peacocks and peahens in the same nuisance category as roosters and to combine the fowl and poultry categories.Applications would have to be submitted to the BOH for permits to keep animals.Abutters would only be notified when the number exceeds the allowed threshold. The Board also added a clause to the keeping of exotic animals "or permitted by Fish and Wildlife" to the section regarding written approval from the SOH for keeping such pets. The Board postponed approval of the new regulations until they have the chance to review and further discuss them. 5 SOUTH MAIN MC was called on Friday, Sept.5 to a small electrical fire in the kitchen at 5 South Main. There was limited water damage. Some food was discarded by the workers. The restaurant was set to reopen on Sunday morning. 8030 PM ANIMAL PERMITS APPLICATION:CHICKENS & ROOSTERS-14 NICHOLS ROAD Al Slanetz(AS) explained that as part of a science project his son was given an egg to take care of through the incubation period and ended up with a rooster instead of a hen or chicken. The rooster resides at the property and has been the subject of complaints from some neighbors. With no further business to discuss, motion was made and approved to adjourn at 9:59 p.m.
