COHASSET BOARD OF HEALTH MINUTES

6:00 P.M. Meeting called to order
6:01 P.M. 285A North Main Street Sanitary Issues, Update
Ms. Fahey visited 285A North Main Street on November 14th to determine if any progress was made by the
property owner in regards to the Order to Correct Violation letter that was sent on October 31, 2019. Ms. Fahey
reviewed images of the property with the Board indicating a huge improvement had been made to clean up the
piles of debris.The Board agreed the property no longer poses a nuisance condition as defined by the ordinance.
MOTIONED BY: Dr. Pollastri moves to send a letter to the property owner at 285A North Main Street noting
he has complied with the Order to Correct Violation.
SECONDED BY: Lynn Doxey
VOTE: 3-0 MOTION CARRIED
6:10 P.M. 17 Adams Road Septic Variance/Easement Vote
At the October 29, 2019 Board of Health meeting a vote was not taken by the Board in regards to the
Variance/Easement request. Ms. Fahey reviewed the request to the Board and a vote was taken.
MOTIONED BY: Ms. Doxey moved the Board of Health grant a variance to residents at 17 Adams Road
allowing maintenance of the septic system within Parcel A and sell that portion of the land
to the abutter while reserving the appropriate access and repair easement as presented on
the plan of land for 17 Adams Road, Cohasset, Massachusetts, prepared by Cavanaro
Consulting, dated October 22, 2019.

Food:
Ms. Fahey has sent emails to food establishments to renew food, dumpster and tobacco permits for 2020. All
food related permit applications are now online, including permanent food, residential kitchens, temporary
food, and mobile food establishments. Full Circle (Software Company) is still working on all Title 5-related
permit applications.
Septic:
Ms. Fahey sent a letter to Chip Nylen, Donald Staszko's attorney,to inform him that the Board of Health (BOH)
must be informed of any maintenance or upgrade actions taken with the failed 380 CJC septic system since
there is an operating restaurant (Feng Shui) that is under the BOH permitting authority. Mr. Nylen responded
that he agreed.
• Bob Egan and Ms. Fahey spoke with John Modzelewski,the engineer approving 390 CJC plans on behalf
of the Planning Board. Mr. Modzelewski later issued the following recommendation to the Planning Board:
"Our opinion is that you cannot make an affirmative finding under Section 12.6.2: you do not have enough
information.Therefore,we do not recommend approval of the submission in its current form.We recommend
as a minimum you should get a sewage disposal design and plans with piping (size, tankage, manholes and
inverts), necessary treatment building (if any) from a registered professional engineer experienced in sewage
disposal design."
• There have been meetings regarding the regional sewer that could potentially impact the 380-400 CJC
plaza. The latest regional plan proposes to send approximately 250,000 gpd of Cohasset flow to Hull and
Cohasset would then accept the same volume and treat North Scituate sewage to protect the Gulf River area.
The higher Hull treatment costs would be passed onto Scituate. Currently, however, the Cohasset plant is not
accepting additional flow, including from properties within the Town.
Beaches:
Ms. Fahey met the New Bedford health director during the annual Massachusetts Health Officers Association
(MHOA) meeting. He discussed beaches and he told me that New Bedford has its own beach testing laboratory
that is certified by the state.The laboratory operates on weekends, unlike G&L Laboratories, so if Sandy beach
is closed Ms. Fahey could bring two samples down on a Friday and have them analyzed on a Saturday.
Potentially this could mean that the beach could reopen on a Sunday rather than waiting until Tuesday.
(Typically if the beach is closed sample(s) are collected on Monday morning and are received on Tuesday).

6:50 P.M. Chairperson's Report
Dr. Lawrence spoke to Chris Senior in regards to changing the BOH name from Board of Health to the Board of
Public Health. Mr. Senior recommended the Board present a warrant article at Town Meeting.
MOTION BY: Dr. Lawrence proposed that the Board of Health bring a warrant article to the town meeting
proposing to change the department name from the Board of Health to Board of Public
Health.
SECONDED BY: Dr. Pollastri
VOTE: 3-0 MOTION CARRIED
MOTION BY: Dr. Pollastri to adjourn meeting at 7:00 PM
