Meeting called to order 6:35 P.M. 130 Doane Street Septic Upgrade, Grady Consulting In attendance for this hearing: Scott Fanara, Grady Consulting, Ed Brennock, abutter Material used for this agenda item: • Application for Disposal System Construction Permit dated June 26, 2019 • Septic System Repair Plan , designed by Grady consulting dated June 26, 2019 • Soil evaluation report dated June 20, 2019 Scott Fanara, Grady Consulting reviewed the septic repair plan for 130 Doane Street. Grady Consulting is proposing to locate the system beside the house with a retaining wall along property line.The wetlands across the street are outside the buffer zone. Grady Consulting is requesting a reduction in the system setbacks and a reduction in separation between bottom of the SAS and high groundwater elevation. Grady Consulting will be going in front of the Conservation Committee on July 25, 2019 for approval due to the wetlands. Mr. Brennock, abutter, had concerns with the new system effecting the drainage system on his property and after hearing Mr. Fanara review the system he realized it would not. MOTION: Dr. Lawrence moved to approve the local upgrade 310 CMR 15.405(1) (b) Reduction in system (soil absorption system) location setbacks to the cellar from state and local requirement of 20 feet to 10 feet. SECONDED BY: Ms. Doxey VOTE: 2-0 MOTION CARRIED MOTION: Dr. Lawrence moved to approve the local upgrade 310 CMR 15.405 (1) (h) reduction in separation between bottom of soil absorption system and the high groundwater elevation from the required 4 feet to 3 feet. SECONDED BY: Ms. Doxey VOTE: 2-0 MOTION CARRIED MOTION: Dr. Lawrence moved to approve the septic repair plan dated June 26, 2019 for 130 Doane Street SECONDED BY: Ms. Doxey VOTE: 2-0 MOTION CARRIED APPROVED 6:40 P.M. 42 Aaron River Road Septic Upgrade,Grady Consulting In attendance for this hearing: Scott Fanara, Grady Consulting, Marc Waegemann, property owner Materials used for this agenda item: • Application for Disposal System Construction Permit dated 6/7/19 • Septic System Repair Plan designed by Grady Consulting dated 6/7/19, revised July 1, 2019 • Soil evaluation report dated 5/21/19 Scott Fanara, Grady Consulting, reviewed the revised Septic Repair Plan for 42 Aaron River Road. Grady Consulting moved the proposed septic system outside the 100 foot buffer zone to the delineated wetlands as requested by the Board. Ms. Fahey and Mr. Federico both agreed it is much more important to increase the distance from the nearest surface water body, Aaron River Reservoir, then the setbacks from the catch basin. Public Health Agent Report for June 2019 APPROVED Food: • Ms. Fahey met with Brian McLaughlin to help him plan for his beer garden to be located behind 12 Parking Way.The plan is for the beer garden to open in August. It will feature pizza prepared in a gas-fired grill and a beer truck with taps from local breweries. After the opening, he will be preparing an associated lounge area to be located in the basement of 12 Parking Way. • Public Health Agent Report to be continued. 6:50 P.M. Update on 380 Chief Justice Cushing Highway In attendance to discuss this agenda item: Jack O'Leary, Engineer from Vertex Company;Amy Kwesell, KP Law,Town counsel. Mr. O'Leary, Vertex Company, met with MassDEP on July 9, 2019. Mr. O'Leary's understanding is MassDEP looked at the history of the properties and arrived at the conclusion even though 380 CJC HWY started as a separate Title 5 system it will now be one facility including 400& 390 CJC HWY exceeding 10,000 gallons per day and it should be considered regulated under 314 CMR 5.00 instead of a Title 5. MassDEP will take jurisdiction once the official decision is made. MassDEP is looking at the septic separately from the enforcement for the additives that were added to the system. Mr. O'Leary would like to do groundwater testing and will continue to pump the system down regularly. Ms. Kwesell was confused stating you can't be regulated under 314 CMR 5.00 that pertains to wastewater treatment plants, and then be allowed to have a Title 5 system, they are two different regulatory programs. Ms. Kwesell spoke to Shaun Walsh, MassDEP, he wasn't aware 390 CJC HWY Disposal System Construction Permit is not valid due to configuration changes on the plan. At this time there will be no sewer coming down CJC HWY.This property has a failed septic system and could be polluting the environment. Dr. Lawrence would like Mr. O'Leary to forward information about the White Night System and the report on the sewer to the Board, Ms. Fahey, and Ms. Kwesell.The Board will wait for further information from MassDEP before moving forward. 7:15 P.M. Continued Public Health Agent Report for June 2019 Septic: • On July 4, 2019 Ms. Fahey received a video showing chemicals being added, once again, to the septic system at 380 CJC.The video shows the chemicals being jetted down into the lines via the d-box in front of Feng Shui.A close up video inside the d-box shows a bubbling reaction consistent with the addition of hydrogen peroxide,the chemical previously illegally added to the system. MassDEP's enforcement division was again notified and will be including the incident in their enforcement action. MassDEP is planning to issue an Administrative Consent Order with Penalty(ACOP)to address the illegal addition of chemicals to the septic system.The case may be presented to the Board for final approval next week according to Mike Whiteside (MassDEP). • Ms. Fahey met with Phil Spath and Jason Federico to discuss the 380 septic system. If MassDEP decides not to issue a groundwater discharge permit because of the potential for a Regional Sewer Project, the BOH collectively agreed it would recommend replacing the existing leaching fields.The fields have served the system for 30 years including three restaurants. Mr. Federico said that he would be willing to grant a variance for the reduction of separation between groundwater and a SAS, but a new leach field would be a requirement.A Regional Sewer project could be at least 15-20 years away. A new SAS should be sized correctly with updated soil perc and flow information. APPROVED Beaches and Pools: • The bacterial testing results have all been acceptable thus far this summer. Ms. Fahey did receive a call from a concerned mother whose daughter developed a rash after spending time in the water at Bassings Beach over the July 4, 2019 holiday.A doctor confirmed that she had swimmer's itch, which a rash is caused by an allergic reaction to certain microscopic parasites that infect some birds and mammals.The parasitic host may have been nearby birds.After receiving notice from CSCR that they are planning to do wading and research in this same area Ms. Fahey passed along a link to a Swimmer's Itch FAQ as a precaution. 7:35 P.M. Public Health Nurse Report for June 2019 • Ms. Goodwin met with Nancy Lafauce, Director Cohasset Elder Affairs, Diane Picot, Assistant director Cohasset Elder Affairs, and Rita, Manager Cohasset Housing Authority.The group discussed many issues, need for social work services, and changes in management at CHA. Ms. Goodwin informed Rita that the Social Service League has offered to fund a 15 hour per week social worker for 5 years to be based out of Cohasset Elder Affairs. Potential candidates currently are being interviewed. • Ms. Goodwin worked with Cohasset Recreation Department to develop Epi Pen Training and reviewed other camp policies • Ms. Goodwin attended the Massachusetts Association of Public Nurses quarterly Executive Board meeting in Milton MOTION BY: Dr. Lawrence to adjourn meeting at 7:50 PM SECONDED BY: Ms. Doxey VOTE: 2-0 MOTION CARRIED
