Meeting called to order 6:06 P.M. 215 Sohier Street Lot A& B New Construction Septic System Design Plan, Morse Engineering In attendance for this hearing: Gregory Morse, Morse Engineering, Paul Colleary, potential owner of parcel Materials used for this agenda item: • Application for Disposal System Construction Permit dated 12/20/18, date stamped 12/20/18 • Septic System Design Plan for 215 Sohier Street LOT A, prepared by Morse Engineering,dated 12/13/18, date stamped 12/20/18, revised 2/12/9. • Septic System Design Plan for 215 Sohier Street LOT B, prepared by Morse Engineering, dated 12/13/18, date stamped 12/20/18. • Form 12 Percolation Test dated 11/8/18, 11/21/18, & 12/12/18, date stamped 12/20/18 • Form 11 Soil Suitability Assessment for On-Site Disposal TP1-TP10 dated 11/8/18 & 11/21/18, TP11 & TP12 dated 12/12/18, both date stamped 12/20/18 Gregory Morse is representing Mr. Colleary who will likely be purchasing the property at 215 Sohier St.The property is made up of two separate lots A& B. Lot A is a vacant lot that would have a new house and a new septic system. Lot B has an existing house and will need an upgraded septic system. James Garfield, a colleague of Mr. Morse,attended the last Board of Health meeting on January 15, 2019 presenting plans for both lots.That hearing was continued until today due to a question the Board had in regards to setbacks to James Brook, a nitrogen sensitive area, (NSA). The Town of Cohasset Supplemental Regulations require a 400 foot setback from NSA and would require an innovative alternative septic system if setback is not met. Morse Engineering went back out to the property and surveyed the location of James Brook. The NSA subsequently added to the Lot A plan as requested by the Board. Mr. Morse stated he could confirm that both septic systems are outside the 400 foot NSA. Dr. Lawrence asked about the tributaries from James Brook that are on the property. Mr. Morse mentioned NSA do not include bordering wetlands or tributaries; the boundary is based on the high water mark and is measured from the bank not tributaries. Ms. Fahey went out to the property and took some pictures to show the Board where the tributaries were located and mentioned the intermittent stream was flowing. Ms. Fahey asked about the Title 5 Regulation of a 200 foot APPROVED setback for tributaries to surface water supply and that one part of James Brook is in a Zone II. Mr. Morse stated the only surface water supply the Town of Cohasset has is the Aaron River Reservoir.Cohasset harbor is not a surface water supply (you do not pull drinking water out of it). A 200 ft. setback from wetlands is not required at James Brook because it doesn't go into a public drinking water supply. Title 5 does not have a setback for streams inside of a Zone II.Title 5 only has a setback if the stream specifically goes into a water body impoundment that is part of the public drinking water supply. Dr. Pollastri agreed that both septic systems meet the regulation requirements based on Mr. Morse's facts. Ms. Doxey was still concerned about the protection of the NSA and will abstain from voting. MOTIONED BY: Dr. Lawrence moved to approve the proposed new septic system design at 215 Sohier Street Lot A as shown on the plan dated 12/13/18, revised 2/12/19 SECONDED BY: Dr. Pollastri VOTE: MOTION CARRIED 2-0-1 (member Doxey abstained from voting) MOTIONED BY: Dr.Lawrence moved to approve the septic system upgrade design plan for Lot B 215 Sohier Street dated 12/13/18 SECONDED BY: Dr. Pollastri VOTE: MOTINED CARRIED 2-0-1 (member Doxey abstained from voting) 6:14 P.M. Update the NSA Map Following the hearing,the Board agreed to have Ms. Fahey and Mr. Federico update the NSA map. Ms. Fahey would like to be more protective of NSA without being overly cumbersome to residents. 6:16 P.M. Review Bodyworks Regulations Ms. Fahey reviewed the new Bodywork Regulations for the Board to approve. Board Members approved the new Bodywork Regulations. 6:21 P.M. Health &Recreation Fair Policy Health and Recreation Fair is March 24, 2019. Ms. Goodwin received an email from a Selectman candidate who requested a table at the Fair. Ms. Goodwin spoke with Chris Senior and Ted Carol who agreed the fair is not a political event. Mr. Senior recommended Ms. Goodwin create a policy regarding who is permitted to have a table at the Fair. Ms. Goodwin shared a written policy with the Board for review. Approve the Warrant Members signed the warrant for 1/15/19 to 2/19/19 6:33P.M. Set Next Meeting Date Tuesday March 19, 2019 at 6:00 P.M. APPROVED 6:35 P.M. Public Health Agent Report Public Health Report February 2019 (see attached) Ms. Fahey reviewed items in her report. • Food: Ms. Fahey conducted a re-inspection at Feng Shui, which has hired a company that completed a professional cleaning in the kitchen.The restaurant is now in compliance and the next inspection will be conducted in six months. • E-Permitting: Permitting of food, dumpster, and tobacco permits have been completed. We will be meeting with a software representative to review a list of changes that are needed before continuing with other types of e-permits (e.g., septic related permits). Use of an iPad-type product in the field to perform food inspections will be investigated. • 400 Chief Justice Cushing Highway Septic: Building inspectional services met with Town Counsel (Karis North) to make sure that the approval for septic plans approved in 2011 for 400 Chief Justice Cushing Highway are still valid. 400 Chief Justice Cushing Highway is a proposed development in the rear of the Stop and Shop plaza. The original plan was for a building with retail space on the first floor. The new proposed use is for a medical office rather than retail on the first floor and 20 units of housing on the second floor. • Safe Harbor Coalition: Ms. Fahey presented a one hour session regarding environmental careers to a group of student ambassadors on February 11, 2019. 6:50 P.M. Public Health Nurse Report for February Ms. Goodwin reviewed her report to the Board. 6:55 P.M.
