Minutes of the Cohasset Board of Water Commissioners
December 16, 2010

Chairman Christopher Seebeck called the meeting to order at 6:35 pm.
Approval of minutes from November 10th meeting brought to board for approval.
Motion made by Chris 2"d by Peter all in favor 3-0 to approve.
American Water Updates:
Norman Lavigne new Superintendent reporting:
Plant Operations - See Attached Report
Chemicals cost predicted to be under cost predicted in budget
PCE test came back non detectible
Lead & Copper passed for a 2"d quarter. Should be able to go back to reduced
testing, awaiting results from state.
Plant Maintenance: See Report
Chlorinator Injector rebuilt, vacuum regulator has been rebuilt and inspected.
Distribution — See Attached Report
Steve May Construction Manager reported there was an incident with the little
harbor project on Jerusalem road 12/15 & 12/16 that took the majority of 2 days
to fix. The reason was that Sewer closed our valves. The commission wants a
bill put together and submitted to Little Harbor Sewer for our time spent.
Avalon: Steve reported that Avalon is looking for trailers to buy and wanted to
know if the Commission was willing to sell trailer which is located on the side of
the Water Department building. Steve will check with Avalon regarding how much
they are willing to pay for the trailer. Steve was directed to make sure that all
utilities are removed properly ie. electric, water, cable etc.

Scituate Hill Tank: Going forward make sure gates are secure, trees and brush
cut back 4' from the fencing around tank. Commission also wanted to make sure
easement is in place once construction is completed for Avalon.
Steve May wanted to speak to Commission regarding a letter from John P.
Sheehan, 138 Atlantic Avenue. Steve read the letter to commission (letter
attached). Mr. Sheehan does not want to pay for the 2" meter which we supplied
for his new 2" meter pit and he wants to now downsize to a 1" meter and not pay
the $542.00 quarterly fee which was on his most recent bill. Commissioner
DeCaprio stated he would contact customer directly and speak with him.
Abatements: The following abatements were presented to the Commission for
review.
19 Atlantic Avenue —Agreed to waive 350.00 summer service fee.
142 Border Street-2 abatements presented both approved $650.16 and
$2031.65. The customer was charged double on water usage. This should have
been put up as a deductible account on the outside usage. Customer will have
plumbing changed before irrigation goes on next year.
28 Reservoir Road —Abatement approved for $578.85, billing system did not
calculate reading properly, program has been fixed.
130 Linden Drive —Abatement approved $476.70, leak in hot water tank.
68 Pond Street —Abatement approved $317.80, leak in hot water tank.
79 Atlantic Avenue —Abatement approved $4,086.00 leak in irrigation system.
14 Summer Street —Abatement approved $136.21, bill was overestimated.
Remote then was fixed and an actual read was received.
470 King Street —Abatement denied. This was a second request from customer
to waive service fee. Denial letter to be sent to customer.
A request was received by the Department from a Mr. Marcus Wraight. He was
looking for the Annual Statistical Reports for the past 3 years as well as any
leaks which had been found. American Water put together the information and
had the Commission review before mailing. The commission stated to mail out
the information as prepared.
Commissioner Pratt stated he received a call from Rick Tinory on behalf of son-
in-law looking for abatement on the property located on Summer Street. Brenda
Douglas reported that Mr. Tinory came to the office and was concerned with the
usage at his daughters home. Brenda told the Commission that the Distribution
staff went out to check home and found no leak. It was also stated that if Mr.
Tinory was looking for abatement to this property that the appropriate paperwork
needed to be filled out, and it was necessary to report the problem which caused
the usage. There was a brief discussion among the Commission and it was
agreed that Commissioner Glenn Pratt will contact him and state that the
commission found no substantial reason to abate any form of the usage.
Project Status:
Phosphate: It was reported by American Water to come in at approx $33,000.
Sludge Lagoons: It was reported by American Water to come in at $65,000.
Little Harbor: No update, Brenda Douglas to meet with interim Finance Director,
Eric Kinsherf. At that time she will confirm account coding and also check to
make sure that all deposits have been credited back to the Water Department in
the correct accounts.
The Commissioners asked if it would be possible to get the next two quarterly
bills out a week to two early. This way it would allow for more revenue to come
in before the end of the fiscal year. Brenda stated she would do her best to get
them out earlier.
Warrant was presented to Commission and only Sludge Lagoons and Phosphate
were signed. Brenda was directed that the new procedure is as follows: Warrant
put together, then brought up to interim Finance Director and interim Town
Manager for approval. Then brought back to Commission for their signatures
then at that point brought back to Town Hall for checks to be cut.
Regs & Fee Schedule
Commissioner Pratt was asked by other Commissioners to look into other towns
fee schedules regarding fire line connections. Attached is report. After a brief
discussion it was decided to table any new fees or increases.
Motion made to go into executive session. All in favor. 9:10 pm
Meeting opened back up at 9:35 and motion made by Chris Seebeck to adjourn,
seconded by Peter DeCaprio, all in favor, 3-0. Meeting adjourned at 9:36 pm.

Executive Session

Litigation Discussion
Commissioner Pratt reported that back in 2003 when acquiring parcels for $175
an acre. The property as I will refer to it "Smith" was sold for $15,000. In 2007
the property was acquired for $15,000. Commissioner Pratt stated that former
Commissioner John McNabb had correspondence going to Smith stating that the
Commission would pay $15,000 for the property as long as all heirs to the
property were notified. Commissioner Pratt was under the understanding that all
were notified. Now "Smith" wants more money and states the land has been
appraised for much more than they were given and wants the difference.
Commissioner DeCaprio wanted to know what the assessment was, but
Commissioner Pratt did not have that information. He stated Town Counsel had
not been given that information to date as well. Commissioner Pratt sated that
instead of fighting just give him the land back and that way there will be no more
lawyer fees. The Commission is already into the lawyers for approximately
$4,000. Commissioner Pratt sated we will be out 15K plus the $4,000 but it will
be done with. Commissioner DeCaprio suggested giving back the land but
asking for the $15,000 back.
Commissioner Seebeck stated that there may be more appropriation money so
that they may be able to pay the difference, but of course not until Mr. Smith has
come up with a dollar amount.
Commissioner Pratt moved to end Executive Session as well as meeting,
Commissioner DeCaprio seconded, in favor 3-0.

LMH has substantial completion. Final ASAP. Still do not have information from
Coughlin Eng. On wrap up.Rebuilt the storm
defender on Jerusalem Rd. Inspected water line 3 to 4
Sewer Gates times per day.
Two bad gate boxes on Haystack Lane Waiting for
sewer dept.?
Still finding sewer boxes with water covers on them.
Example 338 Jerusalem Rd. 150 Beach St.
Hydrant markers blue I emailed Gruber Brennan no response yet. $32.95 ea.
Installed.
Loam and Seed Underway Calhoun on Sheldon Rd. done. Atlantic
from Whitehead done to Cunningham bridge and then
to Rust Way.
Another issue with sewer turning water valves. Sewer
closed two 12"water valve on Jerusalem Rd.
Brendan and I spent a total of 12 hrs. on this issue.

the project is done for the winter. Will visit again next

Avalon Bay Going well. Foundations are in for lower buildings.
Demo going well on old building.
Met on Tuesday with Peter and Avalon Bay with
plumber, electrician etc. ( metering, 3 gate
intersection. Metering issue. I met with Cincotta
General Contractors yesterday to discuss Cohasset
Water Requirements for water mains, valves,
hydrants,gates etc. This will be a major shutdown to
cut into the 3-A 12"AC pipe. We will get$22,000 for
my inspections. Did the commission get the added on
units $8810.00 ea. Questions on the sewer monitoring,
what we want for testing and location of wells and
number of wells. Do you want to sell the construction
trailer?Tom Keeffe to review pump station?
Questions on the State ground water discharge permit
and final draft of the permit dated June 20, 2008 and
settlement agreement for monthly monitoring of
treatment discharge and ground water. Scott Dale was
involved in this. Also the monitoring of the hazardous
waste dates Aug 2010.
Avalon wants 3 two inch meters and 2 one inch
meters soon.
Downtown Revitalization Water Department Construction?
380-400 CJH Proposed Water and Fire Main from Sohier St.Plans
under review. I asked for an 8" loop from 3-A near
Stop and Shop to the new building and on to Sohier
St. with a separate 2"domestic line. Getting price
from Tony to push pipe under CJH.
CJH Aubachone Hardware Fire Service ordered by Boston. Flo test done and will
be billed to Stasko. Fire Chief said he would pay for
test if Stasko does not.=by Fire Dept.

Linden Ponds 988 units are built and about 900 occupied,nothing is
on horizon for additional build outs.Ten of seventeen
are complete and one more clubhouse needed. Water
use is about 90 to 100 thousand gal.per day currently.
Meter issues are being resolved and Harbor Control is
going to Linden Ponds next week to look at the
system fix. Aquarian wants to have a meeting with
Peter, Steve,Norman,Robert Rolland,Ken Morse and
Bill Stuffer Backflow letter
Phosphate Backflow device testing. Draft Letter

I have checked around the local water districts and here are the fees that they have in place for fire connections
Abington/Rockland connection onetime fee$ 1.00 per square foot of building space
$ 200. Per year annual fee
No Private hydrant fee
Scituate No connection fee
$65 . per Quarter fee
Their Regulations say the customer is responsible for the service from the main, (we say
curb stop which puts the cost of digging the street onus if something is wrong, like shut off gets broken by DPW work
we should consider changing our regulations.
Aquarion/Hingham They have no connection or qtr/annual fee
