HomeMy WebLinkAboutMinutes - BoS - 04/09/2019 Selectmen Minutes April 9, 2019 Selectmen's Meeting Town Hall-Selectmen's Office 41 Highland Avenue Cohasset, MA Selectmen Present: Diane Kennedy, Chairman Kevin McCarthy Paul Schubert Steve Gaumer Absent: Jack Keniley Others Present: Christopher Senior,Town Manager Chairman Kennedy called the meeting to order at 6:45 p.m. Roll Call Vote: Kevin McCarthy-Present, Paul Schubert-Present, Diane Kennedy-Present, Steve Gaumer-Present. Chairman Kennedy asked for a motion to go into Executive Session-Exemption #3-To discuss strategy with respect to collective bargaining or litigation if an open meeting may have a detrimental effect on the bargaining or litigating position of the public body and the Chair so declares. The board will discuss ongoing enforcement and litigation. Motion moved by Selectman Gaumer, seconded by Selectman Schubert. Roll Call Vote; Kevin McCarthy-Aye, Paul Schubert-Aye, Diane Kennedy-Aye, Steve Gaumer- Aye. The Board went into executive session at 6:46 p.m. The Board came out of executive session at 7:07 p.m. Public Comment-None License/Events/Permits-Memorial Day Events-Veterans Services Officer Phil Mahoney reviewed the events for this year including a new event with a guest speaker on Sunday 5/26. Mr. Mahoney thanked everyone that supports the veterans. They have plenty of volunteers for the events this year including students. Motion by Selectman McCarthy to approve the Memrial Day Events from 5/25/19-5/27/19 as submitted,seconded by Selectman Schubert and the vote was unanimous (4-0). Cohasset Youth Baseball/Softball Association Parade-Stephen Girardi was present on behalf of the CYBSA. He discussed the parade which has been going on for over 20 years. The Police and Fire departments are on site. The event is scheduled for Saturday, April 27th at 8 a.m. Motion by Selectman Gaumer to approve the application for the CYBSA Parade on 4/27 from 8-9 a.m.,seconded by Selectman Schubert and the vote was unanimous (4-0). Public Hearing-Red Lion Inn-Continued Hearing-Chairman Kennedy read aloud the public hearing notice from 3/19/19. Licensing Clerk Jennifer Oram and Manager of the RLI Pierre Pratt were present. The purpose of tonight's hearing is for the Board of Selectmen to consider removing Condition #7 from the current license conditions to allow an applicant to apply for a liquor license. Selectman Gaumer asked if an applicant could apply for a liquor to sell or serve alcohol. Ms. Oram responded that they could apply for either if they are available. The Board had a brief discussion. Chairman Kennedy asked the public for input. Rowena & Michael Karp-91 South Main Street stated they have concerns that by removing the condition it opens the door for anyone to apply to open a tavern, pub or package store. Mr. Karp added that when the condition was originally placed on the license (19 years ago) it was to protect the surrounding neighbors from disruptions. Motion by Selectman Schubert to remove existing Condition #7 from the Red Lion Inn License stating the following:There shall be no alcoholic beverage service on the first floor of the Lilac House(85 South Main Street) portion of this site. The license holder may operate a bakery in this area, open to the general public, including a seating area not to exceed a capacity of 20 patrons, seconded by Selectman Gaumer and the vote was unanimous(4-0). Motion by Selectman Schubert to close the hearing, seconded by Selectman Gaumer and the vote was unanimous (4-0). Public Hearing-Lenny's Hideaway-Alteration of Premises-Chairman Kennedy read aloud the public hearing notice. Owners Stephanie & Derik Burke were present. They explained that they would like to extend the premises to include outdoor seating area off the dining area on the second-floor roof. The outdoor space is 20 x 28 feet, for a total of 560 square feet. This would accommodate an additional 30 seats for patrons. The area will be contained with a wall/rope. The Board discussed having plans designed before they could decide and get a better idea of the project. They discussed noise in the area. Wayne Sawchuk-432 Beechwood Street and owner of the property stated the Burke's are great owners and neighbors and he fully supports the project. Ms. Burke stated they are looking to modestly increase their space and offer out space. Sean Cunning-15 Depot Court stated he was skeptical of the project but toured it and thinks it would be a great addition to the village area. Tom Hoadley-Manager of Bia Bistro stated they have received a wonderful response from their customers since adding their outdoor seating and thinks it would be a welcomed addition. Chairman Kennedy read aloud a letter of support from the Cohasset Chamber of Commerce. Motion by Selectman Gaumer to continue the hearing until 5/7/19 at 7:20 p.m., seconded by Selectman Schubert and the vote was unanimous (4-0). Public Hearing-Bia Bistro-Entertainment License-Chairman Kennedy read aloud the public hearing notice. Manager Tom Hoadley was present. They are looking to have acoustic music on Sunday and Mondays during brunch from 12-4 p.m. Derik Burke-Owner of Lenny's Hideaway stated Bia runs a good business and shows restraint. Christine Cunning-48 Jerusalem Road Drive stated she thinks it is a great idea and welcomes it. It would be good business for the town. The Board had a brief discussion. Motion by Selectman Gaumer to issue a license for live music to Celtic Bistro Corp.,d/b/a Bia Bistro located at 35- 39 South Main Street, Cohasset. The license is to conduct live indoor/outdoor music from Noon until 4 p.m. Sundays and Monday Holidays exclusively. The license covers only regular operating conditions. Motion was seconded by Selectman Schubert and the vote was unanimous(4-0). Hingham Water Purchase/Impact on Cohasset-Update-Town Administrator Tom Mayo, Selectman Karen Johnson and Jon Asher were present. They gave a power point presentation and discussed the history of the of the Water System, the studies that have been conducted, the financial conclusions, the proposed operating structure and the planning & budget process. The Board had a lengthy discussion. Town Manager Update-Policy for Disposition of Town owned Land-Discussion & Next Steps-The Board had a brief discussion. Chairman Kennedy, Selectman Gaumer and Chris Senior will meet next week and bring back to the board in early May. Mr. Senior advised the Board he had a very productive conversation with Paul Kierce regarding the Affordable Housing Steering Committee and funding to help support projects for Veterans Affordable Housing. He suggested the Board have a longer conversation at the 2 Selectmen Minutes April 9, 2019 5/7/19 meeting. Mr. Senior asked the Board when they would like the Senator and State Representative to come to a meeting with their update. Selectmen Update-Selectman Gaumer stated the Affordable Housing Trust has not been set up and he did not see anything on the Warrant for ATM for depositing any funds. He proposes that the Board make a deposit to the Trust if possible this year. He further suggested that the parcel at 808 Jerusalem Road be put into the Trust. This will set the course for that development. The Board of Selectmen needs to show good faith to the Steering Committee to help them execute their plans. Mr.Senior stated the Board could put money in before the end of the year. Selectman Gaumer advised the Board he will not be attending the meeting on 4/23 or be at the ATM on 4/29. He will be traveling abroad to visit his daughter. Chairman Kennedy asked Mr. Senior to look into a complaint she received about trains running on a regular basis at 2 or 3 a.m. nightly. Mr. Senior will look into. Minutes-3/12/19-Motion by Selectman Schubert to approve the minutes of 3/12/19, seconded by Selectman Gaumer and the vote was unanimous(4-0). Motion by Selectman Gaumer to adjourn, seconded by Selectman McCarthy and the vote was unanimous(4-0).
